{"id":15514,"date":"2021-12-04T10:23:51","date_gmt":"2021-12-04T04:53:51","guid":{"rendered":"https:\/\/northeastrising.in\/?p=15514"},"modified":"2021-12-04T12:23:16","modified_gmt":"2021-12-04T06:53:16","slug":"high-court-directs-meghalaya-govt-dont-implement-entry-exit-regulations-for-outsiders","status":"publish","type":"post","link":"https:\/\/northeastrising.in\/test\/high-court-directs-meghalaya-govt-dont-implement-entry-exit-regulations-for-outsiders\/","title":{"rendered":"High Court directs Meghalaya govt: Don\u2019t implement entry, exit regulations for outsiders"},"content":{"rendered":"<p><strong>Meghalaya, Dec 4:<\/strong> The Meghalaya high court blocked the implementation of entry and exit rules to the state under the Meghalaya Residents Safety and Security Act 2016 that required non-residents to register at check-posts.<\/p>\n<p>A two-judge bench of the Meghalaya high court comprising chief justice Sanjib Banerjee and justice T Diengdoh told the state government to \u201c<strong>let the matter stand over for some time<\/strong>\u201d after the government\u2019s law officer sought time to seek information from the government to respond to the bench\u2019s many questions.<\/p>\n<p>The bench noted that though the government referred to Article 19(5) of the Constitution while drawing up the Act, the grounds on which entry to or movement within the state may be regulated have not been spelt out in the impugned statute or any rules framed thereunder.<\/p>\n<p>Article 19(5) grants the government the power to impose reasonable restrictions upon the freedom to move freely throughout India and the freedom to reside or settle in any part of the territory of the country in the interest of the general public or the protection of the interests of any Scheduled Tribe.<\/p>\n<hr \/>\n<h6><span style=\"color: #ff0000;\"><strong><span style=\"text-decoration: underline;\">Also Read<\/span>:<\/strong><\/span>\u00a0<span style=\"color: #003366;\"><strong><a style=\"color: #003366;\" href=\"https:\/\/northeastrising.in\/dont-settle-assam-border-dispute-in-haste-says-meghalaya-congress\/\">Don\u2019t settle Assam border dispute in haste, says Meghalaya Congress<\/a><\/strong><\/span><\/h6>\n<hr \/>\n<p>&nbsp;<\/p>\n<p>The case has been listed for hearing on February 2 next year.<\/p>\n<p>Petitioner Ibanhunlang Nongkynrih submitted that gates have been set up at several points for checks to be conducted on persons seeking to enter the state without any objective parameters being set down for denying entry or regulating the movement of any citizen of the country in the state.
