{"id":22212,"date":"2023-01-19T11:41:28","date_gmt":"2023-01-19T06:11:28","guid":{"rendered":"https:\/\/northeastrising.in\/?p=22212"},"modified":"2023-01-19T11:41:28","modified_gmt":"2023-01-19T06:11:28","slug":"assam-man-declared-undocumented-immigrant-5-years-back-an-indian-gauhati-high-court","status":"publish","type":"post","link":"https:\/\/northeastrising.in\/test\/assam-man-declared-undocumented-immigrant-5-years-back-an-indian-gauhati-high-court\/","title":{"rendered":"Assam man declared undocumented immigrant 5 years back an Indian: Gauhati High Court"},"content":{"rendered":"<p><strong>Guwahati, Jan 19:\u00a0<\/strong>The Gauhati high court has overturned an order that declared a 40-year-old resident Nagaon in Assam an undocumented immigrant five years back, saying the tribunal that issued it did so without taking into account material on record.<\/p>\n<p>A division bench of justices Achintya Malla Bujor Barua and Arun Dev Choudhury on Tuesday cited the material and stated Md Jamir Ali has wrongly declared a foreigner, who entered Assam after March 24, 1971, the cut-off for detecting undocumented immigrants.<\/p>\n<p>A final National Register of Citizens (<span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/cachar.gov.in\/frontimpotentdata\/national-register-of-citizens-nrc#:~:text=The%20National%20Register%20of%20Citizens,persons%20enumerated%20during%20that%20Census.\">NRC<\/a><\/span>) excluded 1.9 million of the 33 million applicants in August 2019 after a decades-long movement against undocumented immigrants and stoked fears of loss of citizenship and long periods of detention.<\/p>\n<p>The NRC was first published in Assam in 1951. A case was registered against him in this regard in 2009.<\/p>\n<p>The court said the petitioner established his link with Abbas Ali as his father, whose name appeared in the voters\u2019 list of 1965.<strong> \u201cThe materials through which the link was established were not taken note of by the Tribunal,\u201d<\/strong> the court said.<\/p>\n<p>Haliman Nessa, 80, the petitioner\u2019s mother, told the court she was expecting Md Jamir Ali when her husband passed away. <strong>\u201cMy husband was [a] permanent resident of village Goroimari. He died before Jamir\u2019s birth. My husband\u2019s name along with my name appeared on the voter list of 1965.
