New Delhi, April 04: The Delhi High Court declined to entertain a petition seeking the removal of Arvind Kejriwal as Chief Minister of Delhi while he remains in Tihar Jail. The court asserted that it was Kejriwal’s personal decision whether to continue in his role or not.

This marks the second petition dismissed by the High Court seeking Kejriwal’s removal as CM. The court advised the petitioner to approach constitutional authorities, emphasizing that Kejriwal’s continuation in office was a matter of personal choice.

Vishnu Gupta, the petitioner and national president of the Hindu Sena, withdrew the plea and expressed intentions to present his case before the Lieutenant Governor instead.

The petitioner’s counsel argued that Kejriwal’s arrest on March 21 led to a governance vacuum in the capital city.

However, the High Court reiterated that the decision regarding the functioning of the government rested with the Lieutenant Governor or the President.

Refusing to intervene in the matter, the court emphasized that the LG possessed the authority to assess the situation and take appropriate action following the law.

This decision echoes the High Court’s dismissal of a similar PIL filed by Surjit Singh Yadav on March 28.

The court reaffirmed that the executive branch and the President were responsible for addressing such matters, with the judiciary refraining from interference.
